Participant Waiver

By taking part in any of the SwimTribe sessions or events, you (the "Participant") are deemed to have accepted the terms and conditions set out below.

The Participant acknowledges that participation in these group Open Water or swimming activities (the “Training Sessions”) is voluntary. The Participant is personally responsible for their own safety, assumes all risks, and accepts full responsibility for any personal injury, property damage, or death arising directly or indirectly from participation.

The Participant is aware that Open-Water swimming in the United Arab Emirates is hazardous and involves risks such as serious bodily injury, death, or property damage. Pool Training Sessions and Camps & Trips also carry risks including slips, falls, collisions, over-exertion, travel, accommodation, and environmental hazards. The Participant voluntarily participates with full knowledge of these risks and expressly assumes them.

The Participant hereby releases, waives, discharges, and relinquishes any claims or causes of action for personal injury, property damage, or wrongful death that may occur during any Training Session or any activity incidental thereto.

The Participant further agrees that under no circumstances will they prosecute, sue, or present any claim against any member or person associated with SwimTribe (the “SwimTribe Persons”) for any cause of action, personal injury, property damage, or death, whether arising from negligence or any other act or omission of any SwimTribe Person during any Training Session or incidental activity.

The Participant agrees to indemnify, defend, and hold harmless each SwimTribe Person from any loss, liability, damage, or cost incurred as a result of injury, death, or property damage during or incidental to any Training Session, or from any claim arising therefrom.

Consent to Share Information
The Participant consents to SwimTribe collecting and storing their emergency contact details and relevant medical information for safety purposes. The Participant further authorises SwimTribe to share such information with SwimTribe group leaders or staff on a strictly need-to-know basis so they are aware of any medical conditions and emergency contacts during SwimTribe sessions, events, and related activities. All such information will be treated confidentially and used solely for safeguarding the Participant’s health and wellbeing.

This Waiver and Indemnity is governed by the laws of the Emirate of Dubai. If any portion is found invalid by a court, the remainder continues in full force and effect.
