Participant Waiver

By taking part in any of the SwimTribe sessions or events, you (the “Participant”) confirm that you have read, understood, and accepted the terms and conditions set out below.

Voluntary Participation

The Participant hereby acknowledges that participation in SwimTribe’s group swimming sessions (the “Training Sessions”) is entirely voluntary. The Participant understands that SwimTribe does not require or compel attendance at any Training Session, and the Participant may choose not to participate at any time.

Assumption of Risk

The Participant understands and accepts that open-water swimming in the United Arab Emirates carries inherent risks, including but not limited to serious bodily injury, death, or property damage. By voluntarily participating in the Training Sessions, the Participant assumes full and complete responsibility for their own safety and any and all risks arising directly or indirectly from participation.

Release and Waiver of Liability

The Participant hereby releases, waives, discharges, and relinquishes any and all actions or causes of action for personal injury, property damage, or wrongful death which may occur during any Training Sessions or activities incidental thereto.

Under no circumstances will the Participant prosecute or present any claim against any member, volunteer, organizer, or person associated with SwimTribe (the “SwimTribe Persons”) for any cause of action, injury, property damage, or death, whether arising from negligence or non-intentional conduct of any of the SwimTribe Persons during the Training Sessions or activities incidental thereto. SwimTribe does not provide safety supervision or assume responsibility for the safety of Participants.

Indemnity

The Participant agrees to indemnify, save, and hold harmless each of the SwimTribe Persons from any loss, liability, damage, or cost which the SwimTribe Persons may incur as a result of injury, death, or property damage to the Participant occurring during or incidental to any Training Sessions, or from any action resulting from such personal injury, death, or property damage.

Consent to Share Information

The Participant agrees and gives permission for the personal details provided to SwimTribe to be shared with SwimTribe group leaders and organizers solely for the purposes of administration, safety coordination, and communication related to SwimTribe activities.

Governing Law

This Waiver and Indemnity shall be governed by the laws in force in the Emirate of Dubai. If any portion of this Waiver and Indemnity is declared invalid by a court of law, the remainder shall continue in full force and effect.
